Employer & Manpower Agency Terms

These Employer & Manpower Agency Terms ("Business Terms") govern the use of the HireXnow platform (the "Platform") by organisations that register as a Hiring Company or a Manpower Agency. They are entered into between [COMPANY LEGAL NAME], commercial registration number [CR NUMBER], registered at [REGISTERED ADDRESS] ("HireXnow", "we", "us"), and the organisation registering for a business account ("you", "your", or the "Business User").
These Business Terms supplement our Terms & Conditions and incorporate our Privacy Policy, Acceptable Use Policy, and Data Processing Agreement. Where these Business Terms conflict with the general Terms & Conditions on a matter specific to business accounts, these Business Terms prevail. By creating a business account or using the business features of the Platform, you agree to these Business Terms.
1. Definitions
- Hiring Company — an organisation that uses the Platform to recruit workers directly for its own vacancies.
- Manpower Agency — a labour supply or recruitment agency that uses the Platform to offer, list, or place workers, or to recruit on behalf of others.
- Business User — a Hiring Company or Manpower Agency, together referred to in our other policies as an Employer.
- Authorised Representative — the individual who creates or administers the business account on the organisation's behalf.
- Candidate / Job Seeker — an individual who uses the Platform to find or apply for work.
- Candidate Data — personal data relating to a Job Seeker that you access or receive through the Platform.
- Subscription — any paid plan or feature you purchase, as described in Section 8.
2. Registration, authority, and account approval
To register a business account, you must provide accurate organisation details, including legal name, commercial registration or licensing details, and a valid business contact. The Authorised Representative warrants that they are duly authorised to bind the organisation to these Business Terms.
Business accounts and their postings are subject to review and approval by HireXnow before they become active or visible. We may approve, reject, suspend, or request further information at our discretion, including where we cannot verify your identity, licensing, or legitimacy. Approval by HireXnow is not an endorsement or guarantee of your organisation.
3. Manpower Agency licensing
If you register as a Manpower Agency, you represent and warrant that you hold, and will maintain for the duration of your use of the Platform, all licences, permits, and authorisations required to carry on labour recruitment or supply activities under the laws of the Kingdom of Saudi Arabia, and that you will comply with all applicable labour, recruitment, and anti-trafficking laws. You must provide evidence of such licensing on request, and you must notify us promptly if any licence lapses, is suspended, or is revoked. 4. Job Postings and posting approval
You may submit Job Postings for the genuine vacancies you are recruiting for. When submitting a posting, you confirm, via the posting-approval step, that the information is accurate, the vacancy is genuine, and you are authorised to recruit for it. All Job Postings are reviewed and approved by HireXnow before publication. We may approve, reject, edit, suspend, or remove any posting at our discretion, including any we believe to be misleading, fraudulent, discriminatory, non-compliant, or otherwise in breach of our Acceptable Use Policy. You must not charge Job Seekers any fee to apply for or obtain a role.
5. Access to candidates and shortlists
Depending on your account type and Subscription, the Platform may give you access to Candidate profiles, applications to your postings, shared shortlists, and — where enabled — profiles that Job Seekers have made available in the candidate marketplace. Certain access is admin-mediated: for example, requests to connect with a candidate you have not received an application from may be routed through, and are subject to approval by, the HireXnow admin team. You must use all such access solely for the specific recruitment for which the data was made available.
6. Your data protection obligations
Candidate Data is provided to you for one purpose only: the specific recruitment for which it is shared. In respect of Candidate Data you receive through the Platform, you agree that:
- you will process it only for that recruitment purpose, and not for marketing, profiling, resale, or any unrelated purpose;
- you will not sell, rent, or further disclose it without the individual's permission or a lawful basis;
- you will apply appropriate security measures to protect it;
- you will comply with the PDPL and its Implementing Regulations, and with the Data Processing Agreement, which governs the roles and responsibilities of the parties in respect of Candidate Data;
- you will honour any request from a Job Seeker, or from us, to stop processing or to delete Candidate Data where required; and
- you will notify us without undue delay if you become aware of any breach affecting Candidate Data obtained through the Platform.
You are independently responsible and liable for your handling of Candidate Data once it is shared with you.
7. Verified badge
We may award a Verified badge to Business Users whose identity, registration, or licensing we have checked [DESCRIBE VERIFICATION CRITERIA — e.g. valid commercial registration, valid agency licence, domain verification]. The badge indicates only that we performed those checks; it is not a warranty of your conduct, the accuracy of your postings, or any outcome. We may revoke the badge at any time, including where your licensing status changes or you breach these Business Terms.
8. Subscriptions, fees, and payment
Some features of the Platform are offered on a paid Subscription basis. The plans, features, prices, and billing cycle available to you are as presented at the point of purchase. [CONFIRM PLAN TIERS, PRICES, CURRENCY (SAR), AND WHETHER PRICES ARE EXCLUSIVE OF VAT.]

We may change plans and prices on prospective notice; changes take effect at your next renewal. Cancellations and refunds are governed by our Refund & Cancellation Policy. 9. Acceptable use
Your use of the Platform must comply with our Acceptable Use Policy, including the prohibitions on fake postings, charging job seekers, scraping, misuse of Candidate Data, and exploitative recruitment. Breach of the AUP is a breach of these Business Terms.
10. Suspension and termination
We may suspend or terminate your business account, and any Subscription, if you breach these Business Terms, our Terms & Conditions, or our Acceptable Use Policy; if your licensing or verification status changes; if you post fraudulent or unlawful content; or as required by law. You may cancel your Subscription and close your account as described in the Refund & Cancellation Policy. On termination, you must stop using Candidate Data obtained through the Platform except as strictly required to conclude a recruitment already in progress or to comply with law, and you must delete or return it in accordance with the Data Processing Agreement.
11. Warranties and indemnity
You represent and warrant that you will use the Platform lawfully, that your postings are genuine and accurate, that you hold any required licences, and that your handling of Candidate Data complies with applicable law. You agree to indemnify HireXnow against any claims, damages, penalties, or costs arising from your breach of these Business Terms, your misuse of the Platform, or your handling of Candidate Data.
12. Disclaimers and limitation of liability
The Platform is provided "as is" and "as available". We do not guarantee any hire, placement, response, or outcome. To the maximum extent permitted by applicable Saudi law, HireXnow shall not be liable for any indirect, incidental, or consequential losses, or for any loss arising from dealings between you and Job Seekers, reliance on any profile or application, or any recruitment decision. 13. Governing law and disputes
These Business Terms are governed by the laws of the Kingdom of Saudi Arabia, and any dispute is subject to the exclusive jurisdiction of the competent courts of Saudi Arabia [CONFIRM CITY/VENUE].
14. Changes to these Business Terms
We may update these Business Terms from time to time. We will post the updated version with a revised "Last updated" date and, where changes are material, notify you through the Platform. Continued use after changes take effect constitutes acceptance.
